The following terms constitute a legal agreement between you (User) and nucmed.net (Platform). By accessing, browsing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these terms of use. Additionally, you agree to comply with all applicable laws and regulations while using the Platform.

These terms exclusively govern your access to and use of the Platform and do not alter the terms or conditions of any other agreement you may have with nucmed.net. The Platform reserves the right to revise these terms without prior notice. Any updates to these terms will be posted on this page, and it is your responsibility to regularly review them to stay informed of any changes.

Medical Disclaimer

The content available on the Platform is intended solely for educational purposes and is designed for use by medical professionals. It is important to understand that this content should not be utilized for self-diagnosis or self-treatment. It is not intended to replace professional medical care, and we strongly advise consulting your personal physician for any medical diagnosis, imaging interpretation, or treatment plan.

Since the content on the Platform is submitted by individual users, we cannot guarantee its absolute accuracy and assume no legal liability or responsibility for the accuracy, currency, or completeness of the information presented.

Medical practitioners must independently assess and evaluate the content before proposing a diagnosis or suggesting any course of treatment. The Platform should not be considered a substitute for consulting with colleagues, referring to other reputable sources, or replacing conventional medical training and study.

If you are not a medically qualified professional and visiting as a layperson, it is essential to acknowledge that the content on the Platform is provided solely for educational purposes and is intended for use by medical professionals. As a layperson, you agree to utilize this information exclusively for your own private educational purposes and further affirm not to rely on this information in any manner.

Ownership and Licenses

By contributing any content to the Platform (e.g., medical images, including but not limited to SPECT, PET, CT, MRI and other related modalities), you retain ownership of the content, unless otherwise agreed in writing with nucmed.net at the time of submission. However, you grant nucmed.net a license to use such image content under the Attribution-NonCommercial-ShareAlike 4.0, as modified by the provisions outlined in these terms of use (Image Content License).

With respect to image content contributed by you, nucmed.net will have the right to use the content under the Image Content License. However, you will retain ownership of your contributions.

Regarding image content contributed by other users, nucmed.net grants you a sub-license to access and use that content within the bounds of the Image Content License. It is important to note that image content (excluding content contributed by you) may not be modified, copied, distributed, reused, reproduced, republished, downloaded, displayed, posted, transmitted, or sold by you in any form or by any means, except as permitted by the modified CC License, without obtaining prior written permission from the user who originally contributed the content. If the contributing user has delegated such rights to nucmed.net through their Account Settings Page, then nucmed.net may grant you permission accordingly.

Warranty and Disclosures

By contributing content to the Platform ("Your Content"), you warrant that you have the legal right to submit such content to the Platform and grant permission for its use in accordance with these Terms of Use. You further warrant that Your Content meets the following criteria:

  1. Diligent and Professional Collection: Your Content has been collected by you in a diligent and professional manner, adhering to the principles outlined in the Privacy Act 1988 (Cth).
  2. De-identification: Your Content is de-identified to the extent that the identity of each patient to whom the content pertains is not identifiable or reasonably identifiable.
  3. Legitimate and Original Content: Your Content consists of legitimate and original material, including but not limited to radionuclide images (scintigraphy, SPECT, PET, etc.), photos, diagrams, and illustrations, and has not been copied in any way from secondary sources.
  4. Non-Infringement: Your Content will not violate any third-party intellectual property rights when used on or in connection with the Platform.

Regarding Recommendations for Patient Care or Diagnosis:

You warrant that any recommendations for patient care or diagnosis presented in Your Content are based on current scientific evidence, supported by appropriate reference material, and driven by clinical reasoning. If discussing new or evolving practices with limited evidence, you will clearly identify them as such and refrain from advocating or promoting practices unsupported by clinical evidence.

Regarding Disclosures:

You further warrant and commit to the following disclosures:

  1. Freedom from Commercial Bias: Your contributions will be free from any real or perceived commercial bias.
  2. Avoidance of Promoting Specific Commercial Products: You will refrain from promoting any specific commercial products, including pharmaceuticals, devices, software products, or services.
  3. Disclosure of Conflicts of Interest: You will truthfully and fully disclose any potential conflicts of interest, including financial relationships with ineligible companies, regardless of the amount, within the past 24 months. This information will be included in the disclosure section of your user profile, ensuring transparency and avoiding any biases in your contributions.
  4. Timely and Accurate Updates: You will diligently keep your disclosures updated and provide accurate information whenever there are changes or when prompted to do so by the Platform.

By contributing to the Platform, you acknowledge and agree to adhere to these warranties and disclosures, promoting the highest standards of integrity, accuracy, and unbiased educational content within the nuclear medicine community.
